False 498a, 406, 114 and Dowry Cases
Even the Supreme Court of India has noted that matrimonial cases are mostly misused, abused and it is used as a revenge and money making tool. The founder of Live more Family have fought and won 60 different cases and allegation levelled on him in his matrimonial cases. We focus on protecting family values, at the same time preventing elements damaging those values, and offer extensive legal, social, media and investigative support to the victim to come out of false matrimonial cases. False 125 crpc (Maintenance Cases)
The situation of the women in urban area has improved and changed, however laws are dynamic but yet to reflect the true situation of metropolitan educated and settled women. Maintenance is one of the most important case fought by husband, and we have in fact observed cases whereas the demand made by wife was unfaired or wife took away a big sum from husband, then file maintenance case, or level 125 CRPC case with false allegation. Educated and competent wife should not demand maintenance is also growing argument, and various courts in India has passed in and against orders. We have experienced that maintenance cases are technical by nature, and understanding of lower courts and sometimes lawyers are very limited. We apply our resources and legal team to help genuine husband to dispose their maintenance cases in genuine situation, further help them to reduce, revise maintenance in the interest of justice. NRI and Non Indian Residents
While working with husband, wife and families we have found that husband and men working and/or residing abroad has no support from Indian government, however women does. We strongly believe that women have been a victim in our society in general for years. It is now truthful to say that men’s also suffer from laws that are not neutral and bias. That many does not have someone to support them equally. We offer national and international support in 190+ countries for men and their family, to ensure their legal rights, peace and faith on the law is maintained.
Child Custody
Child custody is very complicated, emotional and painful issues every couple and family has to experience. Even the courts find it difficult to make the final call on this situation. Best interest of the child is considerd as the underlying base to decide the custody matters in india.
Guardian and Ward Act, 1890
In India GW Act, 1980 defines the matter related to the child custody, and contested before district court in general. In India, generally it is believe tha the mother maintains the best interests of the children, in a recent times, courts have begun handling this issue without emotions, and based on purely in the interests of the child. Custody are also given to the father, or grandparents. We offer legal, social assistance to deserving and genuine parent to address their grievance and their child interest under our PICR Programs.
Hindu Minority and Guardianship Act 1956
Under this act, only biological parents and not step parents are given the right to seek the custody of their minor child only if he/she is a Hindu. In 1956 as a part of Hindu Code Bills, the Hindu Minority and Guardianship Act along with Hindu Marriage Act, Hindu Succession Act and Hindu Adoption and Maintenance Act were established under the leadership of Jawaharlal Nehru in order to modernize prevalent scenario of Hindu legal tradition. The Hindu Minority and Guardianship Act was established to empower the Guardians and Wards Act of 1890 and provide better right and protection to children instead of acting as a replacement of already prevalent act. with GWA, we also provide aid under the PICR and other non profit membership plans.
Other Acts, Non Hindu Laws
Child custody laws also applies differently on Hindu and other religion community in India. Section 26 of Hindu Marriage Act 1955, Section 38 of Special Marriage Act 1954, Custody under Muslim Law, Custody under Christian Law, are few of other sections and acts of them.
